Terms of Service

These Terms of Service ("Terms") govern your access to and use of DishSnap at getdishsnap.com (the "Service"). By creating an account or using the Service you agree to be bound by these Terms.

1. The Service

DishSnap uses AI to transform food photographs into professional-quality menu images. You purchase credits in packs; each credit is consumed when a transformed image is successfully generated. Credits are non-refundable and do not expire.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract. By using the Service you represent that these conditions are met.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at adrien.charles75@gmail.com if you suspect unauthorised access.

4. Acceptable Use

You agree not to:

• Upload images you do not own or do not have permission to process.
• Upload illegal content including but not limited to content that is obscene, defamatory, or in violation of any third-party intellectual property rights.
• Attempt to reverse-engineer, scrape, or abuse the Service in a manner that places unreasonable load on our infrastructure.
• Use the Service for any purpose other than lawful commercial photography enhancement.

5. Intellectual Property

You retain all rights in the original images you upload. You also own the AI-generated output images produced from your uploads. By uploading images you grant us a limited, non-exclusive, royalty-free licence to process them for the sole purpose of providing the Service. We will not use your images for training AI models or for marketing without your explicit consent.

6. Payments and Credits

All prices are shown in GBP and include VAT where applicable. Payments are processed securely by Stripe. We do not store payment card information. Credit packs are non-refundable once purchased, except where required by law. If a generation fails due to a technical error on our side the credit will be refunded to your account automatically.

7. Availability and Disclaimer of Warranties

We aim for high availability but do not guarantee uninterrupted access to the Service. The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that AI-generated images will meet your specific requirements or expectations.

8. Limitation of Liability

To the maximum extent permitted by law, DishSnap's total liability for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the 30 days preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may close your account at any time by emailing us. Unused credits are forfeited on termination except where prohibited by law.

10. Changes to These Terms

We may update these Terms at any time. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
